A jurisdiction or arbitration clause with a corporation may apply also to its employees

לקוחה של בנק הפועלים שוויץ תבעה את הבנק (תאגיד שוויצרי) ועובד של הבנק.  בית המשפט דחה את התביעה מטעמים של תניית שיפוט.  במקרה דנן ההסכם עם הבנק כלל תניית שיפוט בשוויץ.  בית המשפט קבע כי התניה תיחשב תניית שיפוט ייחודית לאור אמנת לוגאנו, עליה חתומות המדינות, למרות שבהסכם לא נכתב במפורש כי הדיון יהיה רק בשוויץ...

הממונה על מחוז מרכז במשרד הפנים סירב לאשר עסקה של המועצה המקומית מזכרת בתיה הואיל ובן דודו של העותר, אשר הינו חבר מועצה, נכח בישיבת וועדת המכרזים כחבר בוועדה.  בית המשפט ביטל החלטת משרד הפנים בקובעו, בין היתר, כי  נוכחותו של בן דודו של העותר בדיון, אשר אף נמנע מקבלת החלטה לגופו של עניין, אינה מצביעה על אי תקינות הליך המכרז ופסילה על רקע זה בלבד, הינה בלתי מידתית ובלתי סבירה. עוד ציין בית המשפט כי ...

Delay of a city in using a land will not automatically cause the cancellation of the taking by eminent domain

בית המשפט העליון קיבל ערעור על החלטת בית המשפט המחוזי אשר ביטל העברה ללא תמורה של שטח לידי עיריית רמת השרון לאחר שבמשך 22 שנים לא עשתה העירייה דבר עם השטח.  בית המשפט העליון קיבל את הערעור וקבע שבית המשפט לא יבטל הפקעה בטרם שישקול את מאזן הנזקים שבין הנזק לפרט העלול להיגרם אם לא תבוטל ההפקעה לבין הנזק הנשקף לאינטרס הציבורי מביטול ההפקעה העומדת בבחינה...
