A daughter, who inherited her late mother's estate together with her sibling, sought to revoke the inheritance order due to a will in which the deceased bequeathed the entire estate to her.
The Court dismissed the motion to revoke the inheritance order due to undue influence exerted on the testator. The Israeli Inheritance Law stipulates that a testamentary provision made under duress, threat, undue influence, fraud, or deceit, as well as one benefiting the person who drafted it or otherwise took part in its preparation, shall be voided. Here, the beneficiary daughter lived with the mother, worked at the law firm an attorney of which prepared the will, the beneficiary daughter was the one who provided instructions for the will's content and all communication prior to the mother's signature on the will was conducted with her. Therefore, the will in invalid and the heirs are the daughter and her sibling together.
