A Court verdict regarding of a municipal debt payment that was granted 20 years ago because lack of defense should not be canceled

20 years ago a Court verdict was granted in lack of defense for failure to pay municipal taxes. 20 years later after the Court ruling the defendant filed a motion to Court and requested that the verdict that was given 2o years earlier is to be canceled on the grounds that he never received the lawsuit and did not know what and why the claim was filed against him.

The Court held when it comes to motion for cancellation of judgment it is necessary to determine whether a defect was occurred at the time of the judgment and also consider the reason for the absence of the defendant on the one hand, and the defense chance on the other hand.

In the present case, the Court held that the defendant's motion to cancel the judgment is to be dismissed due serious failures. It was proven that the defendant was aware of the existence of legal proceedings in his case almost two decades, but chose not to defend himself.  He also did not filed a motion for the cancellation of a judgment ruling shortly after the date of its issue, or any time close to the execution warning the he have received.
