בני זוג התקשרו בעסקה לפיה בת משפחה תיקח עבורם הלוואה אשר תוחזר בתשלומים חודשיים. בשלב מסוים, חדלו בני הזוג לעמוד בהחזר החודשי ועל כן פתח הבנק הליך הוצאה לפועל נגד בת המשפחה והערב להלוואה. בת המשפחה טוענת, כי בשל הפרת בני הזוג את התחייבותם נפגע שמה הטוב, בין היתר, כתוצאה מהליך ההוצאה לפועל. בית המשפט קבע, כי על בני הזוג לשלם את מלוא הסכום של יתרת חוב ההלוואה בצירוף ריבית. עוד קבע בית המשפט, כי בשל הפרת ההתחייבות מצד בני הזוג הפכה בת המשפחה ללווה שאינה עומדת בהתחייבויותיה ואיבדה את המעמד הטוב שהיה לה בבנק. במקרה דנן, התקבלה התביעה ונקבע כי בנסיבות אלה די בפתיחת הליך ההוצאה לפועל כדי להוכיח פגיעה בשם הטוב.
