במסגרת תביעה נגזרת הוגשה בקשה לגילוי מסמכים. בית המשפט קבע, כי על פי חוק מבקש שזכאי להגיש בקשה לאישור תביעה נגזרת זכאי, בין היתר, גם לבקש גילוי מסמכים הנוגעים להליך אישור תביעה נגזרת כל עוד הועמדה תשתית ראייתית ראשונית לקיום התנאים לאישור התביעה הנגזרת. המחוקק ביקש להקל עם תובע בתביעה נגזרת ולפיכך די, כי יצביע על תשתית ראייתית ראשונית ועל בסיס ראיות חלקיות לאישור התביעה הנגזרת. זאת ועוד, במידה ובית המשפט השתכנע כי בפניו בקשה ממשית שאינה בגדר תביעת סרק הוא ייטה להקל בדרישה הראייתית הנדרשת באותו שלב. באותו מקרה הוגשה הבקשה לגילוי מסמכים אחרי שאושרה הבקשה לתביעה נגזרת. כך, הונחה תשתית ראייתית מספקת המשמשת להצדקת הבקשה לגילוי מסמכים.
