בפסק דין ארוך ומנומק קבע לאחרונה כב' השופט מודריק בבית המשפט לעניינים מנהליים בתל אביב, כי אין מניעה עקרונית כי רשות מקומית שיש בה יועץ משפטי תוציא חלק ממשימות היועץ המשפטי לעורכי דין חיצוניים. בית המשפט העיר עוד, כי על פי נוהל משרד הפנים בנושא, איש ציבור אינו רשאי להסתייע במימון מקופת הציבור לשם טיפול בענייני תביעת לשון הרע בעניינו, אולם ייתכנו נסיבות בהן נכרך האינטרס האישי של איש הציבור באינטרס הרשות להגן על שמו הטוב ואז ניתן, בהליך הקבוע בנוהל, להגיש תביעה בשם הרשות להגנת שמו הטוב של איש הציבור.
