A plaintiff in a sexual harassment claim against the person in charge at ‎the work place is not required to prove to have shown lack of interest

An employee complaint at the police on sexual harassment on her and ‎simultaneously filed a legal claim against the employer. ‎

The Court held that repeated offers of a sexual nature that are directed to ‎a person who showed that lack of interest in such offers are sexual ‎harassment. However, in the existence of employer-employee relationship ‎between the parties, and certainly where relationship of authority exists, the ‎employee is not required to show lack of interest. The Court ordered ‎payment of ILS‏ ‏‎40,000‎‏ ‏‎ as compensation without proof of damage out of ‎the ILS 120,000 that the law empowers the Court to order in such a claim ‎without proof of damage.‎
