בית המשפט הכריע כנגד ועדת המכרזים הואיל ובמכרז שהתפרסם ובו נקבעו אמות מידה שכללו בין היתר ניסיון, המלצות, יכולת עמידה בלוח זמנים ורמת ביצוע גבוהה, בחרה ועדת המכרזים לדון רק בגובה המחיר והתעלמה מיתר אמות המידה שנקבעו במכרז. נקבע כי על ועדת המכרזים לשקול ולפעול בהתאם לכללים אשר נקבעו במכרז וכי אינה רשאית להתעלם מאמות המידה שנקבעו, כל שכן לשנותם לאחר שלב פתיחת ההצעות, שכן שינוי אמות המידה לאחר לבחירת ההצעה הזוכה לאחר פתיחת ההצעות פוגע במציעים אשר הסתמכו על המצג שהוצג במכרז וכן עלול לפתוח פתח לשחיתות ולהעדפת מציע מסוים מטעמים פסולים ובלתי ענייניים. אשר על כן מחויבת ועדת המכרזים להתחשב באמות המידה שנקבעו במכרז, לא להחסיר מהן ולא להוסיף עליהן, ומשלא עשתה כן פעלה שלא כדין.
