Fines – In the application for approval, it was noted that the companies, including their officers, were convicted in criminal cases and fined in the amount of ILS 3.7 million, according to the following details:
1) HCJ (Haifa Shalom) 700-03-20 State of Israel v. Oil Refineries Ltd. [Nevo] (May 31, 2020) was convicted in the framework of a plea bargain on charges of air pollution, recklessness and negligence, violation of conditions of a toxics permit and violation of conditions of an emission permit under the Clean Air Law and the Hazardous Substances Law, following a fire incident at the refineries that occurred in December 2016. In this proceeding, a fine of ILS 1.2 million was imposed on Bazan. Together with BAZAN, three officers were convicted of violating an officer's duty to prevent offenses under the Clean Air Law and for violating an officer's duty to prevent offenses under the Hazardous Substances Law (see Appendices 7 and 8 to the request for approval).
2) In Crim. Crim. (Haifa Shalom) 50114-05-22 State of Israel v. Carmel Olefins Ltd., [Nevo] and its officer (respondent 29) were convicted in a plea bargain at BAZAN and its officer (respondent 29) of the offenses of causing air pollution and violations of the emission permit, after deviations in the emission values were found in the factory chimney between the years 2017-2019, in violation of the provisions of the emission permit and while causing strong and unreasonable air pollution. Bazan was fined ILS 2 million. In addition, as part of the plea bargain, Gadiv was convicted of offenses of pouring oil into seawater, prohibition of dirt in the public domain, failure to take precautionary measures when pumping oil, and violation of conditions of the poisons permit. This was due to an incident on August 18, 2021, in which as part of the loading of benzene to the ship, a pipe exploded and led to benzene spilling into the sea. Gadiv was fined ILS 0.5 million (Appendices 9 and 10 to the application for approval).
