From all of the above, I order that the defendants, jointly and severally, pay the plaintiffs their claim as detailed below:
- NIS 228,472 for the cost of the work carried out for the purpose of correcting the defect.
- NIS 69,800 for mental anguish and various expenses of the plaintiffs, including renting alternative housing during the renovations.
- 6,000 NIS Expert Fees.
- In light of the scope of the documents submitted in the case and the hearings that were required (2 pre-trial hearings and an evidentiary hearing), the court awards attorney's fees in the amount of NIS 54,768 together with VAT in accordance with the law.
- On December 20, 2023, a decision was given by the Honorable Judge G. Ehrenberg according to which the plaintiffs should attach a formal judgment to the signature against defendant 3 in the absence of a defense, however, the plaintiffs did not do so. In the absence of a signature on a previous ruling with respect to defendant 3, defendants 1-3 are all liable jointly and severally in the
- The aforementioned sums will be paid within 30 days from today, bearing shekel interest differentials as required by law from the date the claim is filed until the actual payment.
