Beyond the necessity, I will note that the assault on the girl took place in the evening, in the dark, and according to her testimony, the criminal ordered her to close her eyes, and she did so during the commission of the acts. Therefore, the girl was able to give a general description of the person who committed the difficult acts on her, and obviously, she could not see whether his ears were hairy or not, and it was not proven that the plaintiff's ears were hairy."
My opinion is different. Indeed, the component of the catalogue should have put the matter on me as a memo, but at the end of the day, a notice was taken from him. On the merits of the matter, it is difficult to shock that the composer of the collar fabricated the matter of hair in his ears from his heart, and it is presumed that he put together the collar to the best of his talent and wrote the words out of the maximum details he was able to extract from the minor. And should the component of the cluster have ignored what the minor said? I wonder. As we shall see below, there was also a basis for the claim that the respondent's ears were hairy.
This is therefore the evidence that the police had after the incident, and we note that samples DNA that were taken from the minor were not allowed to locate a profile DNA of another person.
Respondent's Arrest
- About three months after the incident, on July 16, 1999, the respondent was identified as a suspect in the commission of the offense. There is a significant gap between the description in the memoir, which was written by Inspector Yitzhak Stern, who served as the head of the investigation team, following the phone call from the minor's father, and the minor's father's statement as given in his statement to the police about two hours later.
