In his third interrogation on June 6, 2023 (P/7), the defendant reverted to his original version and claimed that he drank four beers and another beer on his way home (P/7B, p. 14, paras. 32 ff.). When he was told that he had chosen to drive and carry a gun while drunk and drunk, the defendant reduced the amount he had drunk and replied: "A few beers, not drunk and nothing" (P/6B, p. 40, s. 2).
In his testimony in court, the defendant again reduced the amount he drank, when he claimed in his cross-examination that he drank 3-4 bottles of beer at home and another beer on his way home (p. 567 of Prot., paras. 5-8).
- He did not go unnoticed because, according to the defendant, he drank this amount of alcohol for several hours, during the afternoon hours. However, there is no dispute that this is a considerable amount that the defendant drank while moving to the incident and that at the end of the day, in practice, the concentration of alcohol found in the defendant is high. In my opinion, the fact that the defendant knowingly chose to drive the vehicle even though he was disqualified from driving and after drinking several cans of beer and even continued to drink while driving, indicates his discretion at the relevant time. In this context, it should be noted that the defendant himself also testified that until that day, he had refrained from driving for a long time, due to his disqualification from driving. In this context, see the defendant's answer in his first police interrogation, when he was asked about it:
"Investigator No. 1, Gil Alon: Tell me what was urgent for you today to go out and drive the car?
Interrogee, Dennis Daniel Mukin: No, just nonsense
Researcher No. 1, Gil Alon: What is just nonsense?
Interrogee, Dennis Daniel Mukin: No, there was nothing urgent. Just

Interrogee, Dennis Daniel Mukin: No, there was no problem, there was nothing, everything was fine. It's just... I don't know, stupid, the first time I've been negative in three years, the first time I've driven, but oh... I don't know, there was nothing urgent."
