Moreover, when it was argued before the defendant that the entire incident began with the defendant getting angry with the deceased's manner of driving, the defendant denied this outright and claimed: "I really wasn't mad at him, that's first of all... Secondly, I didn't understand at all what I did to him that he was coming out so aggressive and aggressive, I didn't do anything, I didn't cut him, I didn't overtake him, I didn't get angry, I didn't do anything that justifies getting out of the car now and running in a dungeon, I don't know what to do with me." (p. 590 of Prut, paras. 21-26).
According to the defendant, when the deceased aggressively got out of his car and approached the defendant, the defendant interpreted the situation as if it were a terror incident, he also got out of his car and fired several bullets in the air. In other words, the deceased was the one who got out of his car first, approached the defendant quickly and aggressively, so that the defendant thought he was a terrorist trying to harm him.
- However, this version of the defendant is inconsistent with what the defendant himself gave in his interrogations with the police, which indicate otherwise.
In his first interrogation with the police (P/2), the defendant described the situation as follows:
"I kept moving forward a little until suddenly the car in front of me didn't ... No, I didn't notice if he came out of the gas station... If he came out of the gas station or he was... Uh... Or he was already on the road, regardless of the gas station, but uh... The Land Cruiser that was in front of me started playing with me on the road... He gave me uh... All kinds of gas brakes and I wanted to overtake him to get home, and he wouldn't let me overtake and... And then he stopped to the side... I stopped next to him... I opened the window and asked what he wanted, and he started swearing and shouting in response, got out of the car, and started moving towards me. I'm uh... I didn't want to wait in the car, wait to see what the tag was. What would he do, so I got out of the car as well, and they started beating me and he jumped on me, jumped on me, started hitting me" (Transcript P/2B, p. 7, from 4 onwards). The defendant emphasized that the deceased reached right up to the defendant's car and stood next to him.
