Moreover, the defendant carried out four sets of antitrust shootings during the entire incident. The first shot was fired in the air when he got out of his car and approached the deceased at the beginning of the incident, the second shot was fired in the air while he was standing next to the deceased's car after the deceased returned to sit in the driver's seat. The third shot was the two bullets that were fired and hit the deceased during the struggle between them. The fourth shot – the three bullets fired by the defendant at the deceased when the deceased moved away from his car after the struggle between them. It is inconceivable that of all these clusters of shooting, in which the defendant fired a total of ten bullets, until the ammunition in his magazine ran out, the defendant did not notice or feel the two bullets that hit the deceased, one of which led to his death.
- Moreover, the defendant's own statements after the incident show that the defendant was aware of the two bullets fired at the deceased.
Immediately after the incident, the defendant spoke with two people and described to them what had happened: one, his sister Kristina, and the other, the head of security at Gan Ner Yaniv Ben Shimol. The statements that the defendant gave to Kristina and Yaniv are essentially similar, with the conclusion that the defendant was aware that he had fired two bullets at the deceased at close range, during the struggle between them on the floor, and that these bullets hit the deceased.
- Kristina was the first person with whom the defendant spoke after the incident, before returning to the scene. In her statement to the police of May 6, 2023 (P/153), which was submitted as a primary investigation, Kristina gave what the defendant told her regarding the events of the incident: "My brother said that my brother in the square turned left and the car overtook him and the Arab stopped him and went out to him, according to my Arab brother, he lowered a window and shouted at him, meaning that the Arab shouted at my brother where he was in a hurry. Then the Arab went out to my brother. Then my brother also came out and they started fighting. I asked him your question, and he said that the Arab attacked him with his hands and knocked him to the ground. To your question, the Arab had nothing in his hands, any tool according to his words... Then the Arab started hitting him, and while they were fighting, the Arab knocked him to the ground, and when he saw that he was not letting go of him, he first shot in the air and then shot him." (p. 2 of P/153, paras. 24-26).
Kristina repeated this description in a similar manner in her second statement of 21 May 2023 (P/154): "... What Dennis managed to tell me was that this car interfered with us on the road and then stopped next to us, they both got out of the car, started shouting and fighting, and then when he knocked Dennis to the floor, he shot him..." (p. 2 of P/154, para. 21).
