It should be emphasized that beyond the clear contradiction that arises from the defendant's statements, in his testimony before us, the defendant repeatedly claimed that he saw that the deceased was unarmed and therefore did not shoot him until the last stage of the incident. This is inconsistent with the defendant's claim in his first interrogation, close to the incident, that he saw the deceased holding something in his hand when he got out of his car. A claim against it, as stated, was not repeated later on, and even the opposite.
- Not only that. In his testimony before us, the defendant claimed that when the deceased ran back to his car after the struggle between them, the deceased threatened the defendant by saying, "You're dead," or "I'll kill you," or something similar. Therefore, according to the defendant, in light of these threats, the defendant feared that the deceased intended to carry out his threat and remove a weapon from his vehicle. However, this claim was not raised by the defendant at all, neither in his first police interrogation nor in the reenactment that was conducted with him that day, in close proximity to the incident. Moreover. The defendant based his aforementioned concern on other reasons. Thus, in his first interrogation, the defendant explained that he thought that the deceased intended to take something out of his car, in light of the manner in which the deceased attacked him as he got out of the car at the beginning of the incident (P/6B, p. 11, s. 9 ff.):
