- As stated, even in the reconstruction conducted with the defendant, the defendant described in detail the course of events (although, as appears from the testimonies and evidence brought before us, not as they actually took place, and there is no dispute about this), but he did not mention in the slightest hint that the defendant made any statement to him after the struggle between them, due to which the defendant suspected that the deceased intended to remove a weapon from his vehicle. It should be noted that at the end of the reconstruction, the defendant watched the video documenting the reconstruction and stated that he did not want to add anything.
- Only in his second interrogation on 16 May 2023, ten days after the incident, did the defendant claim for the first time that when the deceased ran to his car after the struggle, he shouted to the defendant to kill him:
"Interrogator, Dennis Daniel Mukin: Um. And after we actually reincarnated and rabbid, um... He is. After we disconnected, he got up and ran towards the car.
Interrogator, Sameh Hareb: Yes.
Interrogator, Dennis Daniel Mukin: In the meantime. He ran towards the car, shouting, "Now you're dead, now I'm going to kill you."

When the defendant was told in his third interrogation on June 6, 2023, that this detail was added only in his second interrogation, the defendant evaded the weak claim that he may not have remembered to tell the interrogators (P/7B, p. 33, paras. 1-23):
