- As stated, the defendant did nothing to help the deceased, even though he saw that he was wallowing in his blood on the road, did not call the rescue forces, did not contact MDA or the police, but hurried to leave the scene. Although in his testimony in court the defendant claimed that he did not call for help because he saw that there were eyewitnesses at the scene and assumed that they would call the medical forces and the police, in his interrogation with the police the defendant revealed his real reason for this, namely, his lack of care for the deceased and his indifference to the death of the deceased (P/2B, p. 8, paras. 32 ff.):
"Investigator No. 1, Gil Alon: Question, look, you're describing a situation here where you shoot a person, you pass by him, see that he's shot, just drive away
Interrogee, Dennis Daniel Mukin: yes, he came to kill me, what do I need, uh... Go kiss him? What do you want me to do to him?
Investigator No. 1, Gil Alon: No, check if he's alive
Interrogee, Dennis Daniel Mukin: On my cock, if he's alive, he's coming to kill me. For what (unclear word) if he is alive, what am I MDA? Am I a hospital? I'm a policeman, am I that? The son of a bitch came to kill me, he got two bullets, I have nothing to check if he is alive."
- The defendant's additional statements after the incident also indicate his indifference to the injury caused to the deceased, including the fact that the shooting he carried out led to the death of the deceased. Not only did the defendant not express sorrow or remorse over the death of the deceased, but from his various statements it emerges that he does not regret it at all, but even justifies the manner in which he acted, despite the tragic result of the loss of the deceased's life.
Thus, for example, at the very beginning of his first interrogation, P/2B, p. 2, paras. 19-22: "... If he hadn't gotten out of the car and tried to kill me, he wouldn't have died... Every dog has its day, terrorist."
