He further emphasized that if the defendant had made the decision to kill the deceased, as the accuser claimed, he would have had opportunities to do so earlier during the incident.

My late father - Mr. Ahmad Omri:

  1. In this context, see pp. 18-31 of the minutes of the hearing of January 22, 2024. Through the witness, the photograph of the deceased P/1 was submitted.  The father's statement to the police was submitted and marked N/1.
  2. In his testimony, the father stated that his family is a respectable family in the village of Sandala. The father worked all his life to support himself and his family, and they live at a good standard of living.  In addition to the deceased, he has two other daughters.  The father noted that the incident took place the day before the deceased's 19th birthday.  The father said that at the time of the incident, his son left the house for a ride in the car and intended to return to the village via the entrance road to the settlement of Gan Ner, where there is a turn in the direction of the village.  One of the villagers told them that something had happened with the deceased and the father thought it was a car accident.  When they arrived at the scene of the incident, they saw police cars and ambulances and were told that the deceased had been taken to the hospital.  At the hospital, they were informed that the deceased had died.  The father clarified that the distance between their home and the scene of the incident is about 40 seconds on a dirt road.  The father went on to describe the difficulty in coping with his son's death and the consequences of his death for him and the rest of the family.
  3. In his cross-examination, the father confirmed that his statement N/1 was given in Arabic, even though he spoke Hebrew well. The father said that after the incident, the deceased went for a walk in the village and its surroundings as well as a walk in the Gilboa.  In this context, he noted that due to the congestion on the road leading to the Jalameh checkpoint, they sometimes travel to the Gilboa via the Gan Ner bypass road.  The father was referred to the fact that in his statement to the police, he stated that the deceased did not tell him where he was going, but that he thought he had gone for a walk near a park where they meet.  The father explained that it was a park above the village, near Gan Ner, where the young people meet.  The father was directed to the deceased's travel route (P/114), according to which the deceased arrived at the park and then returned to the village.  The father could not say why the deceased returned to the village and why he later drove through the road to Gan Ner.  The father noted that the deceased had been involved in a violent incident in the past, but had not been prosecuted for it and had no criminal record.
