[....] It should be added that even according to Dr. Shlita's version, even without exposure to chemical contamination, cancerous diseases are supposed to develop, along with the other diseases of old age, at an older age (p. 12493 of the minutes of the hearing of January 27, 2008). According to him, the free radicals, which are also naturally created in daily life, and not only as a result of exposure to environmental pollution, accelerate the development of diseases of old age (p. 10 of his opinion). It is impossible to distinguish between the free radicals that are naturally created in everyday life and those that are created, he claims, as a result of environmental pollution [pp. 22-23].
- Even the Supreme Court Other Municipality Requests 6102/13 - 'The Appeal of the 'Kishon and the Divers' Files, Determined, inter alia, regarding the thesis raised by Dr. Shlita, as follows:
One of the fishermen's experts went so far as to the theory of free radicals, and his cross-examination shows that according to him, virtually every activity in our lives – including breathing, living in an observatory in the Galilee, shaving with an electric shaver, using hair dryers, sports, eating, running, smoke emitted from the exhausts of diesel-engined boats, and more – all of these cause an excess of free radicals that cause cancer (pp. 12,512-12,526 of the transcript). The trial court also referred to this theory – which was rejected with both hands by the respondents' experts as a relevant cause of cancer – by saying:
"Dr. Shlita did not know how to quantify the magnitude of the contribution of all those daily activities in relation to the amount of free radicals that were created in the plaintiffs' bodies due to their exposure to the waters of the Kishon fishing dock. Therefore, and for this reason as well, this is a theory on which the existence of a causal connection between the exposure to the materials that were in the waters of the fishing dock in Kishon and the plaintiffs' illnesses" (p. 24 of the judgment).
