Note: The translation of Dr. Sari Libiki's opinion, together with the Hebrew translation of the English translation of the document into Hebrew (which is the opinion of the Scientific Advisory Committee) has been marked 42/2.

  1. Libiki, a chemical engineer by training, noted in her testimony that she works for a corporation called 'Ramble' and that she "...belongs to the small part that deals with environmental and health advice" (p. 1524) and that her opinion "...deals with air quality in Haifa" (page 1556).
  2. The expert was asked why she titled the document she submitted as "report" and not "Exp[e]rt opinion". Her answer: "...There was no particular reason for this.... So in my, in my typical support for court cases, I call them reports. Usually, when I support cases in court that I give documents in support, that's what I call reports" (pages 1605-1606).  And later on -

The witness, Dr. S.  Libiki: Okay, a let's take a look at the report.  You will see that the first sentence in the report or even before, on page 1.1, there is a summary of the opinion.  Page 2 of the first report says this report contains the opinion, my opinion in the file.  And in the second report, it was done in a similar way.  The second report, the first sentence says this report contains my rebottle to plaintiff report and my opinions in this case.  In the second report, the first sentence is written, this report contains my refutation of the plaintiff's reports and my opinion in this case. 

Adv. A.  Amorai:     Okay.

The witness, Dr. S.  Libiki: and.  And also.  1.3, it talks about my opinions in the title and then the first line says the opinions I formed.  So it seems like these would be opinions.  On 1.3 I write my opinion, that's the title.  And in the first line it says the opinion, the opinion I formulated.  In other words, it seems that this is an opinion.

:A                    I, to me, and it, you know I’m not a lawyer.  But my report contains my          opinions.  So it seems that there are semantics involved.  Lee, and I'm no longer a lawyer, The report includes my opinion, so it seems to me that this is a semantic matter.
