On or about April 30, 2014, Fischer and David met with Biton in their office and briefed him again in preparation for his interrogation. At a certain point, Fischer instructed the state witness to come to the office with the envelope she had encrypted. The state's witness did so, and Fisher and David continued to brief Biton ahead of the interrogation with the intention of disrupting her, using the classified documents in the envelope.
- Discovery of Biton's planned arrest date: The date of the transition from an overt to a covert investigation into the "Ma'aseh Nissim" affair was set for Wednesday, May 7, 2014, when Biton was supposed to be arrested by the Jewish Authority. On May 4, 2014, Malka wrote a WhatsApp message to the state's witness stating that "You have to find a heart problem and be hospitalized because on Wednesday morning he gets knocking on the door". In doing so, Malka advised the state's witness, and through her to Fischer, to act in order for Biton to create a false representation that would lead to his hospitalization, with the intention of thwarting the arrest. Biton was indeed hospitalized at Hadassah Hospital in Ein Kerem on May 7, 2014, and thus Malka and Fischer jointly thwarted his arrest. In light of this, the National Insurance Institute decided to postpone the date of the "breakout" to two waves of arrests, on May 19, 2014 and May 20, 2014. On May 8, 2014, Malka sent Fischer another WhatsApp message in which he leaked the new date for Biton's arrest, on May 20, 2014. In order to prepare for his arrest at that time, Fischer stayed with Biton at his home on the night of May 19, 2014. When the National Insurance Institute arrived at Fischer's home on May 19, 2014, in order to arrest Biton, Fischer asked for Malka's advice, in response he advised him to enter the "lawyer's suit" and "fight" for Biton in the best possible way. Biton was indeed arrested at Fischer's home at the time.
- A plan to stop the treatment of the accompanying attorney: This is an attorney who has accompanied the National Insurance Institute in the investigation of the "Miracles" affair since 2012 (hereinafter: The Attorney). The attorney worked at the Tel Aviv District Attorney's Office under David. From 1997 to 2002, David was a direct supervisor of the State Attorney, and during the years that David served as District Attorney (2002 to 2010), she continued to accompany him professionally in the main affairs he handled.
Fischer and David worked together to get the attorney to stop handling the "miracles" case. This is in order to delay the continuation of the investigation and to harm the effectiveness of the handling and management of the case; and in view of the fact that the attorney was the leading force in the case. In order to promote their plan, Fischer and David agreed to offer the attorney the position of legal advisor and director of the legal unit at Netivei Israel in a tender published by the company. On April 28, 2014, David wrote a text message to the attorney asking him to speak with her regarding the possibility of him serving as a legal advisor to the company. In a phone conversation between them the next day, David told the attorney that Netivei Israel needed a legal advisor, and that the company's CEO was very close to Fischer. David added that a tender will be held soon and that an opportunity should be created for a meeting between the attorney general and the director general in order to be impressed by it. In that conversation, David glorified the role and emphasized its seniority. The attorney, who did not know the background to David's proposal and that she and Fischer were connected to Biton, gave her his agreement in principle to run for the position.
