The next day (April 30, 2014), the State Attorney realized for the first time from the investigation material that there was a connection between Fischer and Biton. Therefore, a doubt arose in his heart as to whether David's proposal was not innocent. He shared this with his colleague managing the case, the head of the investigation team, and his supervisor. When David called him again the next day (May 1, 2014), the attorney refrained from answering her, and wrote to her in a text message that he was unable to speak. This is in light of his doubts and his understanding that the purpose of the conversation is to coordinate the meeting. In order not to arouse suspicion on the part of Fischer and David, the State Attorney created a false representation in the State Attorney's Office's diaries that he was assigned to reserve duty. The attorney called Fischer's office, informed him of his departure for reserve duty, and arranged a date for a meeting with Fischer and David on May 11, 2014, which is a later date than the date of the "breakout" that was planned at that stage for May 7, 2014. The attorney did all this with the consent of the head of the investigation team, and in order to ensure that the investigation would not be damaged if Fisher and David's approach to him was not innocent.
On May 4, 2014 (in which, as stated above, Malka leaked to the State Witness the date of the "breach"), the State Attorney called the State Attorney, on the orders of Fischer and David, and asked him to urgently come to a meeting with them in their office in order to submit the nomination documents for the position, since the deadline for submitting the candidacy was brought forward to May 7, 2014. Fischer and David's purpose in summoning the meeting was to create a meeting between the attorney and Biton, who was in Fischer's office at the time (May 4, 2014). The attorney replied to the state's witness that he was unable to attend the meeting because he was serving in the reserves, and that he would later speak with David. Later that day, the State Attorney sent the Attorney General an online link to submit the candidacy, but he refrained from submitting it.
- As a result of these acts, Fisher was convicted of the offense of receiving assets obtained in a crime under the Section 411 of the Penal Law, and in the offense of obstruction of justice under the Article 244 to the law.
Fourth Indictment ('The Alon Hassan Affair')
- The Lahav 433 police unit conducted an investigation in which the chairman of the Ashdod Port Workers' Committee, Alon Hassan (hereinafter: Hassan), on suspicion of criminal offenses. At the time, Fischer provided Hassan with legal services relating to, among other things, the investigation.
- At some point between the end of 2013 and the beginning of 2014, Malka illegally gave Fisher information that an undercover investigation was being conducted against Hassan at Lahav 433, and that Hassan would be interrogated as a suspect. Malka added that he would take responsibility for managing the open investigation. During the month of February 2014, Malka did indeed take responsibility for the investigation. Malka later illegally provided Fischer with information that included the details of the investigation, and clarified that the two affairs known as the "Mishuk Affair" and the "Arbitration Affair" were expected to be shelved, without Hassan being prosecuted in their case, or even being investigated about them, as was supposed to happen. This is in accordance with Malka's recommendation to the competent officials in the State Attorney's Office, by virtue of his status as head of the investigation team. Following the information was provided, Fischer summoned Hassan to a meeting in his office, spoke with him about the investigation, and suggested that in exchange for Hassan's payment – for an unspecified amount – Fischer would make sure that the investigation against him would not mature. Fischer added that he would make sure to transfer the money to the parties involved in the investigation, and they "They will kill the affair".
- On May 26, 2014, Malka wrote a WhatsApp message to the state's witness conveying a message to Hassan and Fischer that the transition from an undercover investigation to an open investigation into Hassan's case was expected to take place the next day. As a result, Fischer contacted Hassan on the same day, and arranged a meeting with him in order to warn him of his expected arrest. Fischer finally made up his mind and canceled the meeting, in light of Malka's remarks about the existence of wiretapping on Hassan's phone line. Hassan was indeed arrested on May 27, 2014. Fischer did not appear for the detention hearing in order to manage the media aspect, along with another lawyer on Hassan's behalf who appeared at the hearing, since Malka responded to the state's witness's question in a WhatsApp message that Fischer should refrain from attending the hearing.
Two days later (Thursday, May 29, 2014), the state's witness informed Malka that consent had been given to release Hassan from detention the next day (Friday afternoon). After his release, on Sunday, June 1, 2014, another meeting was held between Fischer and Hassan in Fischer's office. At the meeting, Fischer told Hassan that if he had accepted his offer and listened to his advice, his arrest would have been prevented. At the same time, Fischer told Hassan that he would be indicted, and asked for his consent.Evacuate and try to minimize damage". Hassan, for his part, authorized Fischer to act in order to bring about the implementation of the proposal.
- On June 15, 2014, another meeting was held in Fischer's office, in which Fischer offered Hassan $150,000 as a bribe.For them", and in return, Fischer will make sure to act illegally vis-à-vis the investigative authorities and assist Hassan in the affairs in which he was interrogated. During the meeting, Fischer warned Hassan not to talk to anyone about the proposal.
On the same day, Hassan met with investigators from the Department for the Investigation of Police, told them about the offer he had received from Fisher and the sequence of events described, and added that he was supposed to meet with Fisher and give him the sum of money. The authorized officials in the Department for the Investigation of Police briefed Hassan to continue to conduct the matter with Fischer, in order to enable the collection of evidence in undercover investigative activity.
- On June 19, 2014, two interrogations were conducted for Hassan at Lahav 433. In one of them, he was interrogated with a warning in connection with the Mishuk affair. On the same day, Malka wrote to Fisher in WhatsApp messages that Hassan had been interrogated twice, and advised him: "In my opinion, you will order him tonight... Will bring a package". Malka also wrote a WhatsApp message to the state witness on the same day, which showed that Hassan was under pressure.
- On June 22, 2014, another meeting was held between Fischer and Hassan in Fischer's office. At the meeting, Fischer emphasized his connections and his successful experience with police officials, and advised Hassan to trust the path he proposes, that there is no other way, and that "One hundred and one percent... There are no zigzags, no quarrels with them... The only one who can shit it, it's just you... With a big mouth, with nonsense". At the same time, Fischer reiterated to Hassan that the money would be transferred in full by him to a police official involved in the investigation who had the power to act to fulfill the promises, and falsely said: "My pocket doesn't see a shekel, a shekel".
- In another meeting between Fischer and Hassan in Fischer's office on June 26, 2014, Fischer again warned Hassan not to discuss the proposal with anyone, not even his wife or father. Fischer made it clear to Hassan that even if his best friend got into trouble, he would be prevented from referring that friend to Fischer to get him out of the mess - "Nothing, doesn't help anyone, doesn't want to. I will choose who I want to help... Just take care of us, that's what I'm asking for". Fischer and Hassan agreed to meet the following week for the purpose of transferring the money.
- In a WhatsApp correspondence between Malka and the state's witness on Tuesday, July 1, 2014, the state witness told Malka, in response to his questions, that Hassan was supposed to come twice day after day: the next day (July 2, 2014), regarding his daughter (against the background of the fact that Malka had leaked to the state witness and Fisher the intention to summon Hassan's daughter for questioning); and on the following day (July 3, 2014), in order to "Closing a Corner", referring to the payment of the money by Hassan to Fischer.
On July 2, 2014, Fischer and Hassan talked to meet the next day in order to transfer the money. Malka, who knew about the planning of the meeting, recommended to the state witness that the meeting should not take place in a café or in a place where cameras are installed. On July 3, 2014, shortly before the meeting, members of the Department for the Investigation of Police handed Hassan a bag that contained, among other things, NIS 100,000 bills, which was expected to contain ₪150,000. Shortly afterwards, Fischer and Hassan met at a café in the Star Center complex in Ashdod. During the meeting, Hassan handed over the file to Fischer, pretending that it contained $150,000. Fischer received the file, and made sure with Hassan that he had counted the amount accurately before handing it over. At the end of the meeting, Fischer left the café with his bag in his possession, and was arrested shortly afterwards by investigators from the Department for the Investigation of Police.
- As a result of these acts, Fisher was convicted of attempted bribery under the Article 25 and section 295(a) of the Penal Law, and in the offense of obstruction of justice under the Article 244 to the law.
Fourteenth Charge ('The Night Meeting Affair')
- In 2014, the Department for the Investigation of Police opened an investigation against Malka, Fischer, the state's witness and others on suspicion of committing offenses in the field of moral integrity. David served as Fischer's attorney during the interrogation. Fischer and the State Committee refused to provide the investigator with the access code for their mobile phones seized during the investigation. During the months of March-April 2015, the researchers were able to penetrate these devices using forensic tools.
Following the intrusion, on April 27, 2015, the Department for the Investigation of Police approached the Jerusalem Magistrate's Court with a request to establish a mechanism that would allow it to review the contents of the devices. The hearing of the application took place ex parte and behind closed doors. At the end of the hearing, a judicial decision was issued that allowed the Department for the Investigation of Police to review the contents of the devices in accordance with the mechanism set out in the decision. In addition, the decision issued an order prohibiting the publication of the hearing, which took place behind closed doors. Nevertheless, in the afternoon of that day, the court's decision was sent to the state's counsel, apparently due to a mishap, and Fisher and Malka learned of it.
- As a result, a nightly meeting was held at Fischer's home to discuss the significance of the decision and its implications for the investigation into the case of Malka, Fischer, and the State Committee. The meeting was attended by, among others, Fischer, David, the state's witness and her attorney. The meeting participants raised possible scenarios for action, if indeed the penetration into mobile devices was successful.
During the meeting, the state's witness expressed her concern about the consequences of penetrating the devices, due to her knowledge that they contained incriminating findings. The state's witness continued to express her desire to leave the country, and as a result, a discourse developed regarding the possibility of her going abroad, in which David also participated. David advised the state's witness – Fisher's and her partner in the offenses – how to proceed during her expected interrogation. Among other things, she said to her: "Your line is to go into the interrogation room and collapse", and instructed her to continue the same line of non-cooperation that she had taken during her previous interrogation as a suspect in the Department for the Investigation of Police. In addition, David warned the state's witness that she would probably be arrested within two or three days, and made it clear to her and Fischer that if the Department for the Investigation of Police had indeed succeeded in infiltrating mobile devices, then it would mean "Disaster", and the future punishment expected of Fischer is significantly more severe than the punishment he would have expected otherwise.
- During the meeting, the state's witness spoke by phone with Malka and shared with him her concern about the upcoming investigation and arrest. Malka asked her to join the meeting and take part in it. The state's witness asked David whether Malka would be able to come, and David answered in the negative. David, who knew that the state's witness, Malka and Fischer, were all suspects together, spoke with Malka herself on the phone; She firmly instructed him not to come to the meeting for fear that he would have to "Surveillance and eavesdropping"; And instructed him not to do it."No sharp movement, that's exactly what they want".
