Second, the company employed an Egyptian employee, a "chemist" as defined by Uri Motsafi, who was in constant contact with industry officials in Egypt, even in those situations in which B&E employees were prevented from entering.

Third, according to Uri Motsafi's testimony, the critical importance of obtaining the visas was more concentrated in the first years after the signing of the Quiz Agreement (i.e., from 2005 to 2007), since these were the years in which the main contacts with the various productive entities in Egypt were established (Prov. p. 221, s. 8).  Even if these statements contradict, to a certain extent, his position in his interrogation with the police (P/277), the logic of the statements regarding the early creation of the connections is also learned from other testimonies, including the testimony of Eskin.

Fourth, also from 2005 to 2007, as indicated by Eskin's letters, the company experienced refusals, but also occasionally received visas.  Hence, it can be said that the situation of a complete and categorical cessation of the granting of visas was not necessarily on the agenda, and it seems that the main difficulty lay in the lack of clear logic in the decisions of the Egyptian authorities, and in the absence of a continuity that would enable proper business activity.  As will be clarified below, Eskin even confirmed in his testimony that it was possible to continue the company's activity even without the visas, but it was possible to expect a decrease in the intensity of the activity.

  1. Still, an examination of all the necessary evidence leads to the conclusion that the continued activity in the Egyptian market was significant for B&E, and it seems that the defense will not dispute this either.

Witness David Khoury, as mentioned He holds an official position on behalf of the State of Israel (In his testimony, a senior field manager at the Customs Administration of Israeli Exports and Free Trade Agreements, a member of the Quiz Committee and the director of trade between Israel and Egypt, described his and other attempts made by officials to assist Israeli exporters and manufacturers in maintaining business ties with Egypt and obtaining visas.

Khoury described how at one of the quiz conferences (attended by Israeli manufacturers and exporters), Uri Motsafi approached him and updated him on the difficulties that the Egyptians were experiencing for him and Eskin regarding entry visas for B&E employees, while asking him to help him.  Because, and there is no dispute about this, that Ben-Eliezer was one of the architects of the Quiz Agreement, Khoury advised Uri Motsafi to contact Ben-Eliezer.
