Incident 8 – It was determined that the appellant tried to force a crying toddler to sit down, and after the chair in which the appellant planned to put the toddler was caught, she waved it and sat him aggressively and forcefully in another chair, while he continued to cry. The appeal should be accepted and the appellant should be acquitted of this incident, on the grounds that her conduct is indeed improper, but it cannot be determined that it is criminal. The use of force against the child is not seen as an expression of violence – but rather a use for a functional purpose, in a manner that does not clearly deviate from what is permissible.
Incident 9 - It was determined that the appellant forcibly pulled a girl from a playground in the yard, and her legs were in the process hit a plastic chair that was there. Although the appellant is aggressive, it is highly doubtful whether she does indeed rise to the criminal threshold, since she only takes the child out of the playground, and according to her, this was done after the girl hit another girl there. The appeal must be accepted.
Incident 10 – It was determined that the appellant dropped a child from a relatively high height to the chicken coop, and she was hit on the mattress. In this matter as well, the appellant should be acquitted. The videos, which document a dark room and the occurrence at a distance from the camera and at a non-optimal angle, do not clearly show that the appellant was indeed dropping the child from her hands, and it is possible that she placed her properly.
