            He has to prove that the flight was canceled in order to avoid desecration of the Sabbath, that's very clear.

Ahmad Tibi:

           Anyone who flies on Shabbat usually does not avoid it, does this clause apply to El Al?

Israel Eichler:

           Not necessarily El Al.

Reading:

           Why not necessarily, is there another company that can be said about?

Chairperson Carmel Shama:

           Any company can keep Shabbat.  Who is in favor of section 7(c)(4)?

After the bill was approved in the first reading, four more sessions were held to discuss the preparation for the second and third readings.  With regard to protections from statutory compensation, the proposal was drafted and read as follows:

           

")c)      Notwithstanding the provisions of subsection (a), a passenger whose flight has been cancelled will not be entitled to financial compensation as stated in section 3(4), if one of the following occurs:

(1)        The flight operator, organizer or travel agency service provider has notified the passenger of the cancellation of the flight at least 14 days prior to the flight time stated on the flight ticket, or if such notice has been given to the passenger between seven and 14 days before the flight time stated on the flight ticket, and the flight operator or organizer has offered him an alternative flight whose departure time is no more than two hours before the flight time stated on the original flight ticket, and the date of its arrival at the final destination is no later than four hours after the original date of landing at that destination."

")2)      The flight operator, organizer or travel agency service provider notified him of the cancellation of the flight less than seven days before the flight time stated on the flight ticket and offered him an alternative flight whose departure time is no more than one hour before the flight time stated on the original flight ticket, and the time of landing at the final destination is no later than two hours from the original date of landing at that destination."
