Moreover, it is doubtful in my opinion whether this doctrine can be based on only one case that is presented in support of the argument that this is what the lawyer always does. And finally, I doubt the strength of the evidence, given that in practice it is a matter of word for word - the word of the witnesses who are brothers - which was not supported by any external evidence (including in particular, not in the recording, even though Mr. Grinzig claimed that he was equipped with such a device, but it was faulty - see his testimony on page 62, lines 1-7) - in contrast to the testimony of Adv. Winder, who denied the claims of these witnesses.
In light of this, I have not found that these testimonies are sufficient to strengthen the plaintiff's claims and version - and in addition - taking into account all the evidence and reasoning as detailed at length above - in any case I do not believe that these testimonies were sufficient to tip the scales.
- Additional arguments raised by the plaintiff and which, according to her approach, are capable of negating the validity of the loan agreement, as well as the validity of its appendices - relate to the defendant's alleged negligence towards the plaintiff, as well as claims relating to oppression and coercion. I will begin with the plaintiff's last arguments relating to oppression and coercion. As for these claims, the plaintiff made these claims in general and in vain - without detailing a specific and concrete distress, for which she entered into the agreement, even though she did not want to enter into it. To this it should be added that according to the testimony of the plaintiff's husband - as quoted above in paragraph 100 of the judgment - the plaintiff's husband was indeed under pressure to promote the construction project in which he was engaged, but admitted that at the same time the defendant did not pressure him to receive money. Similarly, and in addition, the plaintiff's husband testified on page 116, lines 15-18 that:
