Judgment

I.       Overview

  1. This proceeding concerns a claim for a permanent injunction against the defendant requiring it to cease use of the plaintiff's trademarks and other materials that are protected by law and to remove any existing advertising or signage that infringes these rights. They also demanded relief for the payment of bills and alternatively the award of monetary compensation in the amount of ILS 500,000 for the violation of these rights.
  2. Plaintiff - Toyota Jidosha Kabushiki Kaisha is an automotive manufacturer that manufactures and markets worldwide vehicles and car spare parts, as well as provides repair and maintenance services for vehicles manufactured by it ("Toyota" or "the Plaintiff").

Defendant 1 - Company A.  Rehovot Vehicle in Tax Appeal engages, inter alia, in parallel importation and marketing of vehicles and original spare parts of the plaintiff, as well as the provision of ongoing repair and maintenance services for vehicles manufactured by the plaintiff ("Rehovot vehicle" or "the defendant").

Defendant 2 - Mr. Amir Raz is the owner of the defendant ("Raz" or "the defendant").

  1. The plaintiff's evidence in the present proceeding included an affidavit of the main witness on behalf of Mr. Mesut Aslan - a regional manager at Toyota ("Aslan") and on behalf of Mr. Tal Maor - sales manager and VP at Hai Motors, a Toyota authorized dealership in Nes Ziona ("Maor", "Hai Motors"). A professional opinion was also submitted in the field of consumer surveys and public opinion on behalf of Ms. Dafna Goldberg-Anavi ("Goldberg-Anavi").

It is important to note that Aslan's testimony was submitted as part of an agreed hearing arrangement and replaced the affidavit of Ms. Caroline Preel.

  1. The defendant's evidence included an affidavit of the main witness on behalf of the defendant - Raz. A professional opinion was also submitted in the field of consumer surveys and public opinion on behalf of Prof.  Yitzhak Katz ("Katz").  It should be noted that the defendants also submitted an affidavit of the main witness on behalf of another witness, Mr. Yehuda Cohen - sales manager and VP of the defendant, but withdrew his affidavit since this witness did not appear to testify in court.
  2. The emphases in the quotes throughout the judgment were added by the undersigned, unless otherwise noted.

II.    Background to the process

  1. Toyota is a large and well-known car manufacturer in Israel and around the world, and it manufactures and markets vehicles and car parts throughout the world and in Israel, as well as providing sales, repair and maintenance services for vehicles manufactured by it, by itself and through authorized agents, under the TOYOTA trademarks and the company's logo.
  2. Toyota is the sole owner of all the rights in the following registered trademarks in Israel:

The Ottoman Settlement [Old Version] 1916(a) Trademark No.  80633 - "TOYOTA" in Type 37 which includes repair and maintenance of vehicles ("Type 37");
