Also, in P/212, the interrogators told S. that he was lying.  In response, S. referred the

The interrogators to the medical file (p. 36, line 23).  According to S., according to his medical file, he suffers from severe memory problems, and according to him, he is even taking medication (p. 36, lines 25-34).

It should be emphasized that in the course of the interrogation, S. often claimed that he did not remember.

  • Following these statements of 6 March 2016, the next day, i.e., on 07 March 2016, S. was interrogated again (see P/213). Witness S. was interrogated at length, and only on page 48 did he first say the word "stabbed" (and later repeated it, on page 58 of the transcript).  Throughout the investigations, it was evident that the interrogators worked diligently to obtain a detailed version from the witness.

In the course of his interrogation, the subject of P/213, it was stated (at the initial stage of the interrogation) by witness S.:

"... I got to the house, I looked, what, I said what happened, what happened, and then uh, (the defendant) called me, and asked me, say, do you know what happened near my house? Like this and that? I told him no, and by God, maybe you know, it tells me no, I I understood that they attacked her name What a human being, oh, I'll talk to you in a bit, I'll jump on you...(ibid., p. 5, lines 19-24) (my emphasis, S.D.)

Later on (p. 48, lines 11-12) he stated: "We sat down, we sat and smoked a cigarette, he asked me if I had heard about what had happened that someone had been stabbed".  It should be noted that this version came after the witness had previously said that he and S. had been smoking together before the incident, and then each of them went home.  Hence, the investigators found it appropriate to make it difficult for the witness and he gave several versions as to the question of when he sat with the defendant and smoked a cigarette that evening.

Later, at p. 58, S. noted that (the defendant) called him: "But then he asked me, "Tell me, have you heard about what happened here?" With that, I told him what happened? He says to me, "I don't know, brother, I think someone was stabbed near my house(ibid., lines 31-33).
