Subsequently, due to a dispute that arose between Kayuf and the defendant, on a date unknown to the accuser, the defendant forged a form "Declaration of Sale/Purchase of a Right in Real Estate" intended for submission to the Real Estate Taxation, according to which the value of the transaction was ILS 475,000, by signing it with a signature that appeared to be Atef's signature, without her knowledge and consent and without legal authority.  On May 1, 2016, the defendant submitted the second declaration to the Haifa Real Estate Taxation, without the consent and knowledge of Atef, Saker and Kayuf.

The Facts of the Eighth Indictment

  1. At the relevant times of the indictment, the Avlini brothers were registered as the owners of 1000/24073 parcels (representing an area of 1000 square meters) in the land identified as part of Block 17151, Plot 23, within the jurisdiction of the Isfiya Local Council (hereinafter: the "Real Estate").

Jamal Kayuf (hereinafter: "Jamal") and his wife, Friel Kayuf, are the owners of an 8-story commercial building (hereinafter: "Jamal's Building"), located on the main road in Isfiya and known as part of Plot 23 in Block 17151.  On a date unknown to the accuser, on and around September 3, 2015, Jamal sought to purchase the right to own the land from the Ablini brothers, since the land is located in the vicinity of Jamal's building.

On November 8, 2015, due to the refusal of some of the Ablini brothers to sell the ownership of the land to Jamal, Jamal and the defendant agreed that the defendant would purchase for Jamal in trust the ownership interest in 500/24073 lots (representing an area of 500 square meters) of the land (hereinafter: the "plot") from the Avlini brothers (hereinafter: the "Summary"), without informing the Ablini brothers that the plot was being purchased for Jamal.

Later, in accordance with the summary, the defendant approached the Avlini brothers, through Rommel, one of the brothers, in order to purchase the right of ownership of the land from them.  The Avlini brothers agreed with the defendant to sell the land for an amount not less than ILS 280,000, and it was also agreed that the payment of the tax in respect of the betterment levy would apply to the defendant as the buyer.
