On May 10, 2017, the defendant submitted a request to the Land Registry Office in Haifa to register a conversion sale transaction in order to transfer the ownership of the land from the Ablini brothers directly to Said.  He attached to the application, inter alia, a certificate of payment of tax and bills of sale, and on May 11, 2017, ownership of the land in Said's name was registered in the Land Registry.

On 5 July 2017, following a dispute that had arisen between the defendant and Jamal, Jamal contacted the Land Registry Office to find out how the right to own the land in Sa'id's name had been registered without the betterment levy being paid.  During an examination conducted by the bureau clerk, it became clear that there was no certificate and the clerk contacted the defendant in order to provide him with a copy of the certificate.

A few days later, on a date unknown to the accuser, the defendant or someone on his behalf, made a document pretending to be a certificate issued by the Carmel Ridge stating that there was no debt in respect of betterment levy on the land and signed by Yosef Mishlav, Chairman of the Carmel Ridge, without his knowledge and consent, and without legal authority, knowing that there was a debt for betterment levy on the land in the sum of ILS 41,972 and with the aim of evading tax (hereinafter: "the forged certificate") and handed it over to the bureau clerk.

The Facts of the Ninth Indictment

At the relevant times of the indictment, Rachel Pardes (hereinafter: "Rachel") was the owner of "Yonat HaZeit Ltd.", which was registered as the owner of 10,000/38,548 parcels (representing an area of 10,000 square meters), in the land identified as Plot 24 in Block 17158, which are not included in the boundaries of any local authority (hereinafter: "the Real Estate").

On a date that is not known to the accuser, on June 12, 2011, Louis Kayuf (hereinafter: "Louie") approached Adv. Wajdi Kaabia (hereinafter: "Ka'abiya"), as part of his practice, in order to purchase a plot of land in Plot 24 in Block 17158, within the jurisdiction of the Daliyat al-Carmel Local Council.  Later on, Kaabia called Rachel and asked her if the land was for sale, and Rachel replied that she was interested in selling the entire 10,000 square meters as a single piece.
