- At the relevant times of the indictment, the defendant was licensed to practice law and engaged in real estate. Majda Hanani Hasson (hereinafter: "Majda") is engaged in real estate brokerage, although she has never been legally authorized to practice real estate brokerage. Against the background of the defendant's and Majda's occupations, the two had business relationships.
The Facts of the First Indictment
- At the relevant times of the indictment, Ze'ev Beckman (hereinafter: "Beckman"), a resident of South Africa, was registered as the owner of 2,000/40,392 parcels (representing an area of 2,000 square meters) in the land identified as Plot 31 in Block 11514, within the jurisdiction of the Daliyat al-Carmel Local Council (hereinafter: the "Real Estate"). There is no prior acquaintance between Ze'ev Beckman and the defendant.
On a date that is not known to the accuser, close to 11 July 2016, Hadid Munir (hereinafter: "Munir") approached Majda, as part of her real estate brokerage practice, in order to purchase land. Majda offered Munir to purchase the land. After negotiations between Munir and Majda regarding the terms of the transaction, Majda and Munir agreed that the price of the real estate would be ILS 150,000 (hereinafter: the "Transaction").
On September 10, 2016, after Majda updated the defendant on the details of the transaction, the defendant, Majida, Majda's husband, Jad Hasson, Majida's husband (hereinafter: "Hasson"), Lauzan Munir (hereinafter: "Lausanne"), Fares Munir (hereinafter: "Fares") and Munir met at Munir's home in the village of Daliyat al-Carmel.
On this occasion, the defendant fraudulently presented to those present a document entitled "Sale Agreement", dated September 10, 2016, in which it was written, inter alia, that Beckman undertook to sell the land to Lausanne and Fares in exchange for a payment of ILS 75,000 to be transferred to Beckman at the time of signing the sale agreement (hereinafter: the "Sale Agreement"), without Beckman's knowledge and consent. The defendant signed the sale agreement with Lausanne and Fares, knowing that Beckman was not aware of the sale agreement and did not authorize himself to sell the land and that the consideration actually paid to the defendant for the land was ILS 150,000.
