On February 16, 2009, the defendant submitted, inter alia, the deed of sale to the Land Registry Office, with the intention of allowing the registration of ownership of the 450 square meters of the land, fraudulently, in the name of Yaniv at the Bureau. Following an employee of the Land Registry Office contacting the defendant that according to their records, a portion of 500 square meters had been purchased, the defendant submitted a letter to the office requesting that the warning note registered in Yaniv's name be canceled, without Yaniv's consent and knowledge and without lawful authority.
Based on the forged bill of sale and other documents, the registration of ownership of 450 square meters of the land was fraudulently transferred to Yaniv's name in the land registry.
In his actions, the defendant received, for Majda, 50 square meters of the land, fraudulently under aggravated circumstances.
The Facts of the Fourth Indictment
- At the relevant times of the indictment, the late Avraham Ben Moshe (hereinafter: "the deceased") was registered as the owner of 500/22,120 parcels (representing an area of 500 square meters), in the land identified as Plot 48 in Block 11519, within the jurisdiction of the Daliyat al-Carmel Local Council (hereinafter: the "Land"). The deceased died on 18 January 2000 and his heirs are his two children.
At the beginning of 2017, Inmar Hasson (hereinafter: "Inmar") approached Majda, as part of her real estate brokerage, in order to assist him in purchasing a piece of land.
The defendant and Majda agreed to defraud Inmar and the deceased's heirs, in such a way that they would transfer the deceased's rights in the land to Inmar, without the knowledge and consent of the deceased's heirs and unlawfully (hereinafter: the "Summary").
Following the conclusion and in order to promote it, Majda informed Inmar that she had located an area of land owned by a person who wished to sell the land and offered him to purchase the land for ILS 150,000, and Inmar agreed (hereinafter: the "Transaction"). In addition, Majda told Inmar that the defendant was handling the transaction, as part of his practice as a lawyer.
