On a date that is not known to the accused, during the year 2010, prior to August 17, 2010, Amla Halabi (hereinafter: "Amla") approached Majda, as part of her real estate brokerage practice, in order to purchase a certain part of the land. In accordance with the summary and in order to promote it, Majda falsely presented herself as having a permit on behalf of the owner of the land to broker a sale transaction of the land (hereinafter: the "Second Misrepresentation") and offered to purchase a certain portion of the land, which constitutes 500 square meters, of the land (hereinafter: the "Plot"), all without Rafael's knowledge and consent. Amla agreed to purchase the plot and agreed with Majda that the price of the plot would be ILS 90,000, with ILS 50,000 to be paid to Majda in cash and the balance to be paid in monthly installments. Later, Majda referred Amla to the defendant in order for him to transfer the rights to the plot in her name. Later, in August 2010, the defendant and Majda presented Amla with a forged document titled "Sale Agreement" in which it was stated that Rafael was selling the plot to Amla for ILS 90,000. Subsequently, after and around August 17, 2010, Amla paid Majda ILS 50,000 in cash (hereinafter: the "First Payment") and the rest in monthly installments that are not a fixed amount, amounting to ILS 40,000. Majda transferred the first payment to the defendant.
On a date unknown to the accuser, on August 2, 2012, Tareq Hussisi (hereinafter: "Hussisi") approached Majda, as part of her real estate brokerage, in order to purchase a certain portion of the land. In accordance with the summary and in order to promote it, Majda falsely presented herself as having a permit on behalf of the owner of the land to broker a sale transaction of the land (hereinafter: the "Third Misrepresentation") and offered him to purchase a certain portion of the land constituting 750 square meters (hereinafter: the "Area"), all without Rafael's knowledge and consent. Subsequently, Majda and Hosissi agreed that the price of the area would be ILS 180,000, with Majda demanding that ILS 150,000 be paid in cash and the balance after registering the rights in the Land Registry in the name of Ms. Najwa Hussisi, Hussisi's wife (hereinafter: "Najwa"). Later, Husisi paid the defendant, in the presence of Majda, ILS 150,000 in cash, at the defendant's office in Daliyat al-Carmel.
