The defendant did not check whether Aviel held a driver's license, he did not check whether Aviel was prohibited from driving, whether he was fit to drive (in view of the use he has made or is using dangerous drugs), he did not check whether the insurance (which he did not even know existed) covered Aviel's driving, especially since according to the defendant the defects that were found in the car a few weeks earlier were not repaired or properly treated by Eliran Sabag. Especially when the defendant (according to him) has not yet purchased it and he is not the owner of the Chevrolet car. The defendant did not even ask Aviel Dadon for what purpose he was requesting his car, and he did not bother to inform Aviel Dadon that it was not his own car, but rather a car that had undergone an accident, which was repaired as a result, that the repairs did not satisfy him, that he had paid for its purchase only partially, and that he was not registered as the owner of the vehicle at all. According to him, we are dealing with matters "marginal, not just marginal, I don't delve deeper, I don't research, I tend to believe." When told that he may have acted illegally, he replied, "It could be, I have no idea, I didn't do anything intentionally or knowingly." In the past, he claims, he never gave Aviel a car, and the latter did not ask him for it. As stated, the defendant knew Aviel as Shimon's son, but never visited the housing unit where Aviel lives, nor did he drink with him or dine with him. Afterwards, the defendant changed his mind and claimed that when he visited the father, the son joined them. When asked, "Maybe the son is a criminal, maybe he's going to commit murder with the car?" he replied, "Anything can happen, I know my father since childhood, his grandparents, I know the whole family from a young age, we've known him since we were zero." The defendant, according to him, was aware that Aviel had some behavioral problems, but was not aware of the drug problem, and later claimed that he knew about it. He also claimed that he would meet Aviel at his workplace, at Shufersal in the vegetable department, "Sometimes he would bring me fresh merchandise."
