The defendant was asked if his children visit him at his place of residence on Tishbi Street, and he answered in the negative, when he has time, he meets them at the family's home. According to his version, as part of the divorce, it was agreed that he sees them "without limitation." Some of his children certainly don't know where he lives. As for his home on Tishbi Street, they may not know about him, "I think only Ariel knew. [...] It could be that he knew that Menashe Dahan is a big supplier of liquor and that Ariel takes goods from him, so it could be that only Ariel is still there."
The defendant said that he used to frequent the family home at 18 HaGevorah Street, in accordance with his own interests, and would hitchitch from HaTishbi Street to HaGevora Street, "Every car that sees you standing takes you. [...] Yes, every car, people know you too, and everyone who goes up sees you."
In his testimony, the defendant took the trouble to explain that he did not live at the time in the house at 18 HaGevora Street in Nesher. Sigal Avioz , who was married to him, also clarified this (September 15, 2024, p. 4337 onwards).
We were not positively impressed by the testimony of both of them. Sigal even took the trouble to explain unconvincingly that she did not know where the defendant lived or who lived in the house next to her, the gate to which was adjacent to the gate of her house (September 15, 2024, pp. 4368 ff.). Sigal also came to the defendant's defense, claiming that the defendant was in possession of a telephone, but she did not know his telephone number, while in her interrogation she explicitly stated that "as far as I know, he has not had a phone for years" (p. 4380). The evidence presented proved that the defendant has a clear connection to the house at 18 HaGevora Street, and that it also serves as his residence, even if the rent is for different needs and the housing unit changes elsewhere.
As part of the proceeding, quite a few agreements were submitted, including agreements in which it was recorded that the defendant, who was then called David Avioz, lived at 18 Gevvora Street in Nesher.
