Incriminating behavior by the defendant
With regard to the Chevrolet car used before and after the murder, we will recall that the defendant arrived at Rafi Abdayev's business compound and asked him to return the car to the parking lot from which it was taken, i.e., to "get rid of" the vehicle, as Fouad Fares put it (13 February 2022).
This behavior of the defendant is incriminating on the one hand, and on the other hand, indicates great sophistication. It was not for nothing that the defendant asked not to be tied to the Chevrolet car, just as he did six months later when he threw the ride in the Chevrolet car on the shoulders of the late Aviel Dadon. The defendant's action was a calculated and manipulative action intended to complicate Rafi Abdeev and absolve him of responsibility for the Chevrolet car. Investigator Fouad Fares was asked why the claim regarding light bulbs that were lit in the car was not examined and therefore it was left in the possession of Rafi Abdeyev, but it is clear that the defendant was supposed to bring the car to the lot from which it was taken, if he really wanted to return it until all its defects were corrected.
Leaving the Chevrolet car near Rafi Abdayev's business was and remains a planned action, but it is obscure and unexplained by the defendant. His explanations in the defense affair sounded forced and false. Apparently, according to Fouad Fares (December 13, 2022, p. 1510), the defendant was simply unaware that the vehicle had an Ituran device installed and that it could be used to detect its route, even if the vehicle was for sale in a car lot that had been involved in accidents. In fact, it was the Ituran device that led to the exposure of evidence against the defendant and his incrimination.
The evidence that is in the defendant's duty and which has been proven before us beyond a reasonable doubt
The Chevrolet car, from which two men wearing teddy bear coats got out and walked towards the deceased's home, was in the defendant's possession from the evening of 21 March 2021 until his arrest on 26 March 2021.
