The Defendant and the Chevrolet Vehicle, the Movements of the Chevrolet Vehicle and the Use Made of It - Evidentiary and Factual Issues
In this proceeding, the Chevrolet vehicle constitutes first-class circumstantial evidence.
Significant testimony about him was heard from Eliran Sabag on November 29, 2022 (starting at p. 1304).
Eliran Sabag is a car dealer (those involved in accidents), and according to him, assisted in the sale of the Chevrolet (Malibu type), 250-03-101 sq.m., to the defendant. According to the claim, the Chevrolet car was in an accident and was purchased by a man named Adir Machluf Sror, and the latter later asked Eliran Sabag for assistance in selling it. He agreed to help, and since the office was rented by Ariel, the defendant's son, near the parking lot, he also assisted in the sale of the car to the defendant for his son Ariel. The defendant took the vehicle for a test drive, even though the vehicle had not yet been fully reused. Later, after passing a licensing test and the required repairs, the defendant took him into custody after paying (at the expense of the consideration) the sum of approximately ILS 30,000 (in the cross-examination, he did not rule out the possibility that ILS 20,000 was discussed, p. 1351, para. 25). According to him, the transfer of ownership of the Chevrolet vehicle was not made, but was supposed to be done by the owner, to whom the sum of money paid in cash was also transferred by the defendant. Even before that, the defendant asked to replace the battery, to pass the vehicle for a licensing test, and to prepare it for sale. However, the witness was later told that Ariel was not interested in the Chevrolet at all because he wanted a sports car. Eliran Sabag also spoke about this with Ariel (it should be noted that these words were said in the testimony of the witness in the presence of Ariel, who was sitting on the benches at the time, and it was stated at the same hearing that he was not expected to testify in this proceeding, although in the end he testified on behalf of the defense).
