12-34-56-78 Chekhov v.  State of Israel, P.D.  51 (2)10.        During the month of October 2020, as part of his role as a lawyer and receiver on the plots, the deceased filed an opening motion with the Haifa District Court, against the defendant and others, in which the court was asked to issue a declaratory judgment regarding the ownership rights and possession of the heirs in the plots.

  1. Against the background of the dispute and the legal proceedings that the deceased conducted against the defendant, the defendant made a decision to kill the deceased, some time before what is described in section 13 below.
  2. On March 21, 2021, the defendant purchased a Chevrolet Malibu car, M.R. 250-03-101 (hereinafter: "The Lineup"), from a car lot in Nesher (hereinafter: "Parking lot").
  3. Prior to March 24, 2021, on a date that is not known to the accuser, the defendant conspired with another person whose identity is unknown to the accuser (hereinafter: "The Other"), causing the death of the deceased (hereinafter: "The Context").
  4. Further to the above, on 24 March 2021, at approximately 5:00 A.M., the defendant and the other arrived in the vehicle, driven by the defendant, to HaMaginim Street in Nesher, parallel to the street where the deceased lived, armed with two knives (hereinafter: "The knives"). The defendant stopped the vehicle near the stairs leading to the deceased's home, and the other got out of the car and walked towards the deceased's home.  The defendant parked the car a short distance from the scene, got out of the vehicle and walked towards the deceased's home.
  5. Further to the above, the defendant and the other approached the deceased's car, which was parked opposite the house, wearing "teddy bear" coats (hereinafter: "The Coats"), whose hats cover their heads, and also wear "corona masks" and gloves on their hands. The defendant and the other cut one of the tires of the deceased's car with the knives they were carrying, together with them.
  6. At 5:21 A.M., the defendant and the other opened the entrance gate to the house and entered the yard, where they hid and waited for the deceased to leave the house, in order to kill him.
  7. At around 6:30 A.M., the deceased left the door of his home, on his way to work in the office, accompanied by his wife. At this point, while the deceased was standing at the entrance to the house, the defendant and the other attacked the deceased and stabbed him with knives.  The deceased fell to the ground and the two continued to stab him many times, with the intention of causing his death, all in front of his wife.  During the stabbings, the deceased's wife tried to fend off the defendant and the other, but without success, and while doing so, she was injured in her hands by the knives that the two were holding.

Copied from Nevo18.       Together, the defendant and the other caused the deceased about 37 stab wounds and cuts in various parts of his body, including about 17 stab wounds and cuts in the chest and abdomen, on the left torso and in the left abdomen, as well as stab wounds and cuts to the scalp, face, neck, right arm and left thigh.  Some of the stabs penetrated the deceased's leg and liver.

  1. The death of the deceased was caused by a stab wound in the heart, most likely by a mechanism of heart failure and the blockage of the atonement, possibly with an element of blood loss.
  2. After the above, the defendant and the other left the yard of the house, walked toward the vehicle and fled the scene, while the defendant was driving.
  3. The defendant and the other drove to Daliyat al-Carmel, where they hid the shoes that the defendant was wearing at the time of the murder among the bushes, on Stockholm Street, and later, in the area near the exit from Daliyat al-Carmel, they hid the coats among the bushes. Afterwards, in an area near Tiberias, on a side dirt road, the defendant and the other threw car mats and two license plates that were in the car, which had been stolen from a vehicle in Kiryat Motzkin on 23 March 2021.  All of this was done by the defendant and the other, together, with the intention of preventing or thwarting a judicial proceeding or bringing about a miscarriage of justice.
  4. Further to the above, at approximately 10:00 A.M., the defendant arrived at the compound in the Kiryat Yam Industrial Zone (hereinafter: "The complex in the industrial zone"), and asked an acquaintance of his, who is a business owner in the complex, to transfer the vehicle to the parking lot, with the intention of preventing or impeding a judicial proceeding or leading to a miscarriage of justice. On 25 March 2021, since the vehicle remained in the compound in the industrial zone, the defendant arrived at the compound and drove away with the vehicle.
  5. On 26 March 2021, the defendant was arrested by the police while he was driving.
  6. The defendant, in his actions described above:
  7. caused the death of the deceased, together with the other, after planning and after an actual process of weighing and formulating a decision to kill, and using special cruelty, which was expressed, inter alia, in the large number of stabbings and the commission of the murder in front of the eyes of the deceased's wife.
  8. He injured the deceased's wife, together with the other, while they were carrying cold weapons and in a group.

III.     He intentionally damaged the vehicle, together with the other, the vehicle or part of it.

  1. He did, together with the other, speak with the intention of preventing or thwarting a judicial proceeding or bringing about a miscarriage of justice.
  2. He threatened Moshe with unlawful harm to his body, liberty and livelihood, with the intention of intimidating him.

Therefore, the defendant was charged with committing the following offenses:
