If so, the deceased's conduct, according to our determination, was a thorn in the side of the defendant, especially since he believed that the deceased was not objective but an interested party. This is what the defendant said about the eviction claim filed against him by the deceased, in a hearing held in the Haifa Magistrate's Court, in Civil Case 22055-01-19, on January 15, 2019 (P/495), "There is deception by the court. I took pictures of then and pictures from today. And the court will tell me what has changed. It's all about interior renovation. Moreover, even to the area that he is the receiver himself, he is a party to the matter, I didn't know that, until Yossi Mandel told me. I asked them to go to court, it is inconceivable that there are accusations that do not have a minimal basis for everything that is happening here. Not about me and not about the committee. The pictures will illustrate. We've been suffering from this situation for 25 years, and it cost us a fortune."
Unfortunately, it seems that one day, as the proceedings in the courts progressed, especially since his claim in the District Court was dismissed (while he was charged with additional expenses and expenses if he wished to renew it), while the eviction claim filed against him by the deceased in the Magistrate's Court was and is pending, the defendant decided to take action. As an "opening shot" to the defendant's thought and attitude, we will recall what was agreed upon by the parties, that two years before the murder, in a hearing held at the Haifa Magistrate's Court on February 25, 2019, the deceased "said things that could darken the defendant's face that were offensive to the defendant that came to him from the rumor, and that this thing was in him [...] to clarify that the dispute was a hot one" (see: July 16, 2023, p. 2969).
Contrary to the defense's arguments in its summaries that claims of motive collapsed as if they did not exist, we are of the opinion that an evidentiary foundation was laid, clear, clear and unequivocal, regarding the existence of a bubbling dispute between the two, a dispute that is certainly likely to give rise to a motive to remove the deceased from the way.
