This decision concerns remedies relating to the common property that is centered on the real estate corporations that the man manages:
The woman claims that the man is trying to smuggle assets and therefore petitions to join all the corporations as defendants, to appoint an investigative accountant, to appoint a special manager or receiver, to impose an injunction, to give instructions to the Registrar of Companies, to instruct the man to transfer payment to her on account of the division of the property, and to take steps in accordance with the Contempt of Court Ordinance. The man opposes most of the remedies on the grounds that there is no smuggling of assets, when the requested remedies are liable to harm the management of the corporations and there is no room for early distribution of funds. Here are the main points.
Background and Procedures:
- The parties married on 5 July 2006 and had six children, including five minors. The parties led a religious lifestyle and a particularly high standard of living, living in a luxury penthouse apartment, owning a vacation apartment inanother locality and other properties. Their main source of income is a cluster of eight real estate corporations managed by the man, whose accounts are managed in all banks in Israel.
- Their life together came into crisis in April 2025, when the man left the shared apartment and moved in with another partner in the center.
- On May 22, 2025, the woman initiated a dispute resolution proceeding (Dispute Resolution 111) in which she petitioned for the imposition of temporary foreclosures on all the joint properties and all the assets registered in the man's ownership. On July 13, 2025, the Honorable Registrar ordered the imposition of temporary foreclosures in respect of the two apartments, in relation to additional real estate assets registered in the man's ownership and in relation to his rights in a number of insurance companies, in a holding company and in all banks in Israel. In addition, half of the rights in the company was foreclosed on a tax appeal in which the man holds all the shares, but not on the other corporations, inter alia because they are not a party to the proceeding.
- On July 27, 2025, the woman filed a request for a protection order against the man (threatening harassment and protection order 222), claiming that he came home late at night, under the influence of drugs and alcohol, threatening and breaking things. With the consent of the parties, without admitting the allegations, a protection order was issued for 3 months.
- On August 4, 2025, the woman filed three claims:
a claim regarding parental responsibility and time spent with the children (in claims after the settlement of litigation 333);
