(1) To the team On the Provision of Information and the Provision of a Guarantee;
(2) Determine Actions that require the consent of both spouses;
(3) Order on Recording an appropriate note In a register that is managed according to the law in which the property of one of the spouses is registered. "
It is a settled rule before us that this provision should be used wisely, only in appropriate cases, as held by the Supreme Court (the Honorable Justice Matza) Other Municipal Applications 1915/91 Knobler v. Knobler, PD 49(3) 529, 637:
"An expansive interpretation of the elements of the grounds entitlement to this remedy may "not only preserve the property but also blunt the sting of means of pressure and extortion." I have examined and found that in a number of cases, in which relief was granted by district courts, this approach was indeed adopted. In some of these cases, it was even determined that in order to receive injunctive relief, the plaintiff's spouse is not obligated to prove that his spouse has already committed an act of concealment of property."
It was further determined that the remedies listed in section 11 mean the imposition of foreclosure orders, injunctions, the appointment of experts, etc., in order to ensure the preservation of the rights, even before the balance of resources is imposed.
- With regard to any type of temporary relief, Regulation 30 of the Family Court Regulations (Procedures) 5781-2020 establishes the applicability of Chapter 15 of the Civil Procedure Regulations in the changes of the obligatory.
Regulation 94 of the Civil Procedure Regulations, 5779-2018 (Cologne: 5641) states:
"The purpose of the interim relief is to ensure a prima facie right during the legal proceedings and the proper and efficient conduct of the proceeding or the proper execution of the judgment."
Regulation 95 of the Civil Code states:
AA Ltd. A request for temporary relief shall be submitted in writing and subject to this chapter.
(b) If a request for interim relief is filed in the framework of a lawsuit, the court may grant the requested relief, if it is persuaded, on the basis of prima facie sufficient evidence of the existence of a cause of action, the fulfillment of the conditions for granting the relief as stated in this chapter, and the necessity of the interim relief for the purpose of achieving the goal.
