The Normative Basis for Engagement
- For the sake of convenience, we will define the plaintiffs at the preamble of the judgment. The players - the plaintiffs will be defined by name. The defendants are the Hapoel Jerusalem Football Club (hereinafter the Club). The Jerusalem Football Association (hereinafter: the Association), the Jerusalem Sports Team - Football in Tax Appeal (hereinafter: the Company), and Mr. Victor Yona (hereinafter: Mr. Yona).
- The soccer team is duly registered and incorporated with the Football Association.
- The association is legally registered and manages together with the group.
- The company is a private limited liability company.
- Mr. Victor Yona - According to the plaintiffs, he received a management agreement from 1996 signed between him and S.A.D.R. Sport Management in 1995 in a tax appeal - financial responsibility in the team, and payment to the players. In the statement of defense of the team, the association and the company, it was stated that "according to an arbitral award that was given the force of a judgment in the Jerusalem District Court, all the past debts of the soccer teams are imposed exclusively on Mr. Yona," and they even asked to file a third-party notice against him. (paragraph 5 of the statement of defense) Thus, the defendants confirmed the plaintiffs' claim regarding Mr. Yona's obligation to pay all such payments. This arises from the arbitrator's own award (P/11) which refers to the arbitrator's decision of 10 May 2005, which he validates in his judgment.
- Before we discuss the claims of each of the plaintiffs on the merits of his claims, the periods of his employment and the circumstances of their termination, it is necessary to address the fundamental arguments that arise in the issues common to all the plaintiffs in relation to the legal and contractual situation that applies to them. The plaintiffs claimed that the agreements were not honored and that the agreements were made orally. Even if one picture or another emerges in the testimonies and affidavits, as also appeared in the judgment of the Honorable Justice Zeiler as an arbitrator, we still have to examine the agreements that were made in writing and the normative basis in this type of transaction.
- Section 10 of the Sports Law relates to the regulations of the Football Association, and states:
"10 (a) An association or association shall enact bylaws that will regulate the proper procedure of the industry...
