(c) The other regulations will bind the sports association, the athletes and the official holder in that sport..." (Emphasis mine, S.S.).
- The Israel Football Association's Budget Control Authority, through its chairman, responded to the court's order and issued a notice regarding "the players' agreements entered into regarding the seasons that are the subject of the lawsuit."
Whereby all the agreements were sent to the plaintiffs' attorney except for the agreements 1989-90 and 90-91 to plaintiff 3 and a notice that plaintiff 5 did not play for the club in the 2000/99 season.
This announcement by the Budget Control Authority stems from the rules detailed in the Budget Control Regulations, which states:
"5 A(1) The agreement between the team and the player will be drawn up on a form purchased at the Association's offices in the form set out in Appendix A and/or Appendix A(1) and in the case of a player who is foreign to these Regulations, or as amended from time to time by the Association's management, which will be hereinafter referred to as the "Players Agreement Form". The parties will be entitled to add in writing to the agreement form supplementary terms that will serve as an addition to the prescribed version, provided that any such addition shall be made on the sheet of the agreement form and within the framework thereof and shall not deviate or contradict the clause of the agreement and the clause of the articles of association.
The agreement will specify all the payments that will be paid to the player, of any kind and type, whether in money or in money, indirectly or directly. All sums will be stated in shekels and gross amounts, all in accordance with the stated and declared in the agreement (hereinafter: the consideration). (Emphasis mine, S.S.).
- It is clear that the Budget Control Regulations require that every player agreement form be in writing, including "and all mutual commitments.... direct and indirect" and others that will be expressed in writing. In addition, according to Section 13 of the Budget Control Regulations, "the validity of an agreement is contingent on its registration by the Authority and its approval by the Chairman of the Authority by signing it in the margins of the agreement. Without the signature of the chairman of the authority, the agreement will be null and void. It is invalid and invalid, and they will not act according to it. ". (Emphasis mine, S.S.).
It is clear, therefore, that the condition of registering everything agreed upon in writing in the agreement between a player and a team is essential and requires registration in the budgetary control, and in the absence of such registration, the agreement has no validity and effect and will not act in accordance with it.
