The pedophile content, published by Defendant 1, included, among other things, a video of about a minute in which a boy and a girl aged 9-12 are seen touching each other's genitals, and in addition, the girl performs oral sex on a child; a minute-long video in which an elderly woman is seen inserting a small child's penis into her genitals; A 3.5-minute video showing a naked adult man leaning over a naked 6-9 year old girl with her legs spread and a video showing a 5-7-year-old girl undressing and showing her penis exposed to the camera.
- The parties reached a plea bargain whereby defendant 1 confessed and was convicted of the facts of the amended indictment, referred to the Probation Service for a mandatory report due to his age, and to the Center for Sexual Dangerousness Assessment, without the parties reaching a punitive agreement.
- To complete the picture, I will note that Defendant 2 is charged with a separate charge and his case has not yet been concluded.
- Sexual Risk Assessment as of October 31, 2024
- In the assessment of sexual danger submitted in relation to the offense of publishing obscene material in which a minor was determined, it was determined that the level of sexual danger posed by the defendant was medium-low.
The opinion reviewed the circumstances of the defendant's life from childhood until the date of its drafting, including his relationship with his family, peers, personality and sexual patterns. The risk assessment was of the impression that the extent of engagement with sexual content involving minors indicates a concern of sexual interest in minors. At the same time, there was no impression of sexual deviance, there was no evidence of sexual abuse off-line, other than the publication of the obscenity. The impression is that the defendant formally understands the wrongdoing of his actions, focused on the consequences of his actions on his life, and expressed a superficial understanding of the damage he caused to the victims of the offense. It was recommended to continue long-term dedicated treatment that would enable an in-depth clarification of the motives underlying his criminal and sexual behavior.
- Probation Service Reports
In the case of the defendant (born in 2002), three probation service reports were received.
- The first report, dated February 16, 2025, reviewed the resume of the defendant, about 21 years old, single, living in his mother's house and working in a car dealership in the field of sales. As the report shows, his family was facing financial hardship, his parents divorced five years ago, contact with his father was severed, and for a period of time the father did not pay alimony. The defendant completed 12 years of schooling with a partial matriculation certificate, served full military service in a classified unit, and about six months after his release from military service, he was arrested for his involvement in this case.
The defendant described normal sexual development. According to him, for the past two years he has been in a relationship with a 17-year-old girl in which he has experienced sexual satisfaction. The defendant denied it to the probation service; Sexual attraction to minors, a variety of increased sexual needs, and according to him, there is no need for paid sex. He approved viewing pornographic content with adult characters, as a means of sexual arousal during periods when he was not in a relationship. In addition, he denied sexual abuse in the past.
