In these circumstances, and to the extent that the statement of claim is required to be amended, the plaintiff can petition for its amendment, and in this regard, the parties' arguments are reserved.  The parties' arguments are also reserved with regard to the law, in light of which the plaintiff's claims must be examined in the direct contractual context.  Thus, the plaintiff claims that the negotiations to conclude the agreement were conducted in bad faith on the part of the defendant.  It is doubtful whether this argument, and the argument regarding defects in amputation, are supposed to be clarified in accordance with English law.  As stated, I will not make any decisions on this matter, since this is not required for the purpose of deciding the application.
