[1] The products listed in Appendix A were five hooding systems (types: WCK6, WCK 9, WCK 16, WCK 20, WCK26, all "in accordance with UL300") and "bus system in accordance with SI 6218".
[2] The letter originally referred to three specific distributors. In its statement of defense, Lehavot claimed that it was later agreed to exclude additional distributors. In their summaries, the parties do not refer to the distinction between the distributors in this matter, but rather focus on the question of consent to the exclusion.
[3] The exhibit, which was also attached as M/143, ostensibly bears the date of January 31, 2018, but this is a technical matter stemming from the printing of the document; There is no dispute that this is a letter dated July 18, 2017 (p. 216, s. 27 – p. 217, s. 3), which is mentioned in a letter dated July 20, 2017 from Lehavot (M/114).
[4] Although a question by the counsel in one of the hearings allegedly included a claim that this activity hadceased in January 2017 (pp. 36, 6-7).
[5] This exhibit also technically bears the date 31.1.2018, but this is not the correct date. This is a letter that was sent after the notice of termination of the agreement (20.7.2017) and apparently preceded the letter from 17.9.2017.
[6] In the context of the argument of surprise, see section 73 above. It may also be noted that in a letter sent two days before the termination notice, counsel for Danan wrote that he hoped that his letter would be answered in a substantive manner and that the "conciliatory spirit" of the letter "will not be translated into weakness" but rather "as a hand outstretched for peace" (M/133, paragraph 7). To teach you that Danan has taken into account the possibilities of action of flames.
[7] See also: "There is no one who deflects." There are those who believe that where such a phrase is incorporated into a statement of claim, it is more likely that it is the same matter in the disputed issue (compare: Ran Lustigman and Michal Aharoni and Adv. Portrait of Legal Hebrew in Israel 237 (Rubik Rosenthal, ed. 2016)).
