It was further claimed that after the defendant left the place, the defendant advanced towards the back entrance of the house, and walked between it and the backyard, until, at a certain point, he entered the house.  It is attributed to him that further to the above, and in circumstances unknown to the accuser, inside the house, he hit the deceased in the head and face, and stabbed him many times, with a knife, in the head, neck, chest, back, and upper limbs.  At a certain point, the deceased fled to the backyard.  There, under the pergola, he collapsed on his back, bleeding.

It is also attributed to the defendant that at this stage he approached the deceased, leaned over him and continued to stab him, repeatedly, in the upper body, with a knife, while the deceased tried to defend himself from him, with his last strength.  Neighbor Y.A.  (hereinafter: "The Neighbor" or "Y.A." ), who was standing not far from there, noticed what was happening, and called rescue forces to the scene, while at the same time shouting at the defendant: "Maor, leave him, leave him." At a certain point, the defendant let go of the bleeding deceased and left the scene through the front entrance of the house, with his hands bleeding from cuts.

The Ottoman Settlement [Old Version] 1916Rescue forces rushed to the scene found the deceased in the backyard of the house, lying on his back, bleeding from penetrating wounds in the face, neck and chest, broken teeth, and bleeding in the oral cavity.  The deceased, who was unconscious at the time, reacted to pain and suffering from shortness of breath, low saturation and a weak radial pulse, and murmured that he was about to die.  He was treated with fluids and respiration, without improvement, and was evacuated for medical treatment at Soroka Hospital, while his condition deteriorated, where he was pronounced dead.

  1. The indictment further detailed that as a result of the defendant's actions, the deceased suffered many fatal injuries, including: more than 120 cut and stab wounds on the upper body - on the head, neck, chest, back, upper limbs and hands, as well as blunt bruises in those areas of the body.

It was claimed that the deceased's death was caused as a result of the defendant's actions, and various medical scenarios were detailed that led to the tragic result.  In the meantime, it was attributed to the defendant that by his actions described above, he deliberately caused the death of the deceased under aggravated circumstances, and with special cruelty, which was expressed in multiple stabbings and blunt bruises that caused the deceased excessive suffering.
