The causal connection between the stabbings and the fatal result is not severed due to the subsequent medical actions.
Additional Forensic Evidence, Evidence from the Scene, "Peripheral" Evidence and the Question of Their Weight and Significance
- Some, not a small one, of the findings collected at the scene, and of the testimonies regarding these, including DNA evidence and analysis of blood splashes, have been reviewed and will be reviewed, mainly so as not to shorten the line, and for the sake of reassuring us, that these too have been and are before us. In fact, the significance and weight of these are not significant for a decision. This is due to the existence of direct positive evidence and evidentiary testimonies regarding the stabbing of the deceased by the hands of the defendant, and these are of great and decisive weight, and they are due to the defendant's line of defense.
Even if we accept the defense attorney's approach, according to which most of the stabbings took place inside the house, and not on the balcony, in the witnesses' field of vision, it is difficult to see the importance of reconstructing the instructors and the arm movements of the hawks, including from the analysis of the blood stains, when the defendant does not claim self-defense against the attack on the deceased, and a "one-on-one" fight between the two, but rather the assault of both of them by unknown outsiders. In the words of the summaries: "A complete mess of a number of people involved."
Therefore, the main question is not whether it is true, as the accuser claims, that the forensic evidence completely negates the presence of external involvement, but rather, the question is in the opposite direction - whether this evidence establishes the presence of strangers and their involvement in the fight, or, at least, whether there are indications, at the level of reasonable doubt, that there were other persons present at the scene other than the deceased and the defendant, at the same time and in the same place where the interaction between them took place.
