The expert reiterates (for example, at p.  544) that the laboratory can continue to compare the samples against the profile of any other person, including a family member, who will be asked to examine his programming as a contributor to the mixture.  This is not something that the time has missed to do.  In any event, the defense did not initiate such a move.

From the aggregate - the DNA findings that were examined do not confirm the defense's claim of the existence of additional persons involved.  Insofar as there was an intention to cast doubt on the robustness of the determination regarding the mixture of the defendant and the deceased only, whether by submitting another opinion, or by way of a request to examine additional samples, these were not done and were not requested by the defense.

Allegations of Investigative Failures and Failure to Testify

  1. The defense presented a number of arguments, which, according to him, could have cast doubt on the accusing evidence, or served to strengthen his defense. I will address them only briefly, since I have not found them to change the conclusions that have been formulated.

Failure to summon essential witnesses - the defense raised a grievance, that various witnesses were not brought to testify and give a version, which might have benefited the defendant and substantiated his version.  Naturally, to the extent that the accuser refrained from testifying from any of the prosecution witnesses named in the indictment, or that a relevant witness was not included in it from the outset - there is no impediment to the defense summoning it, and in the absence of a convincing explanation as to why this was not done - this argument has no basis.

Other Investigative Failures - In the defense attorney's summaries, as well as during the trial, there were many allegations of various omissions made during the interrogation, whether regarding the knife seized at the scene or on other issues.  The summaries detailed alleged investigative failures, and various deficiencies in the conduct of the investigative unit, including: failure to find security cameras near the scene, failure to locate and download the contents of potential additional security cameras, failure to remove certain phone outputs, etc.
