Therefore, the plaintiff is entitled to payment in lieu of advance notice for the months of notice during which he was prevented from working.Antitrust 22.796 ₪.
- Redemption of Freedom
The plaintiff is demanding payment of vacation redemption for 21 vacation days, of which vacation days are listed on the pay slip and another 4 vacation days for the notice period.
The defendant did not present a vacation book and did not prove that the plaintiff took advantage of vacation days. The defendant claimed that the plaintiff was busy publishing a book during his working days. This claim was made in vain and without detail. Therefore, the claim is accepted. The defendant will pay the plaintiff a redemption of freedom in the amount of ILS 43,176.
- Convalescence Pay
The plaintiff is demanding payment of convalescence pay. He claimed that convalescence pay was paid only partially.
In the statement of defense, the defendant referred to the employment agreement. In the "consideration" section, the plaintiff's salary was detailed and it was determined:
"The salary includes all the various salary components and increments, including travel as an independent component, and the employee will not be entitled to any additional payment unless this is explicitly stated in this agreement."
The employment agreement does not contain an explicit clause regarding convalescence pay. It follows that convalescence pay was included in the wages.
However, an examination of the coupons revealed that during the period of employment , the plaintiff was paid convalescence pay in August 2017. In other words, the defendant paid the plaintiff beyond what was stated in the employment agreement, but we did not find that an additional payment was paid for convalescence pay in addition to the aforementioned payment. In addition, in the defendant's summaries there is no claim that convalescence pay is included in the salary, but rather that all the convalescence pay to which the plaintiff is entitled have been paid. This claim was made without elaboration.
